What is diyat?

Diyat is the compensation paid to the heirs of a person who has been killed. Islamic law sets it at 100 camels (the Quran orders diyat for a killing by mistake, Surah an-Nisa 4:92), or its equivalent of 1,000 dinar of gold or, in the Hanafi madhab, 10,000 dirham of silver. In Pakistan it is part of the Pakistan Penal Code (Qisas and Diyat law), and it applies in cases of qatl-i-khata (killing by mistake), qatl shibh-i-amd, and in qatl-i-amd where qisas is not enforced.

How the amount is fixed

Section 323 of the Pakistan Penal Code says the court fixes the diyat, but it may not be less than the value of 30,630 grams of silver. The Finance Division works out that value and notifies it for each fiscal year, from 1 July to 30 June. The silver weight never changes; only the rupee figure does, because the silver price and the rupee move. 30,630 g is very close to the classical 10,000 dirham of the Hanafi madhab (10,000 × 3.0618 g = 30,618 g).

Why the amount almost doubled in 2026

The notified amount was Rs 98,28,670 for 2025-26 and Rs 1,93,52,390 for 2026-27, an increase of about 97%. The reason is the price of silver, which rose sharply in the year before the notification. The table in the calculator lists every notified amount we have checked, with its source, and the live value shows where the next notification may land if silver prices stay where they are.

Live value or notified amount: which one counts?

For a court case, the amount notified for the year is the legal minimum. The live value on this page is for information: it shows what 30,630 g of silver is worth today at the international spot rate. Local bazaar silver rates in Pakistan are often a little higher than the spot rate.

How diyat is paid and shared

  • Instalments: under section 331 of the Penal Code diyat may be paid in a lump sum or in instalments spread over up to three years from the final judgment.
  • Who receives it: the heirs of the person killed, in their shares of inheritance (see the wirasat calculator).
  • Compromise: the heirs may forgive the diyat or agree on a different amount (badal-i-sulh) where the law allows.

Diyat in the different madhabs

All schools agree on 100 camels as the basis. For gold, the figure is 1,000 dinar. For silver the Hanafi madhab gives 10,000 dirham and the Maliki and Hanbali schools 12,000 dirham; in the Shafi’i school the camels are the basis, and their value is paid when camels are not available. In Shia fiqh (Ayatollah Sistani) the options include 100 camels, 1,000 dinar or 10,000 dirham. Pakistani law follows the silver measure of 30,630 g.
